Terms of Service

Article 1 (Purpose)

These Terms set forth the rights, obligations, responsibilities, and other necessary matters between Cuddles ANC Inc. (the "Company") and users in connection with the use of the AI-based conversational plush toy and its related applications / web services (the "Service") provided by the Company.

Article 2 (Definitions)

  • "Service" means the AI-based conversational plush toy features, toy/app connection and configuration features, conversation generation and management features, conversation transcript storage and access features (where provided), subscription payment, customer support, and all other related functions provided by the Company.
  • "User (Member)" means a person who agrees to these Terms and uses the Service, and is, in principle, an adult (guardian) account holder.
  • "End User" means a person (including a child) who directly speaks with the plush toy or uses the Service under the management and supervision of the User.
  • "Conversation Data" means (i) conversation text transcripts, (ii) technical metadata such as conversation time and device information, and (iii) information input or configured by the User in the course of using the Service.
  • "Audio (Voice) Data" means the raw audio (recording) data collected through the plush toy or the app.
  • "Paid Service" means features and services provided as a subscription or for a separate fee (including in-app purchases).
  • "Store" means app marketplace / payment platforms through which Service payments are processed, such as the Apple App Store and Google Play.

Article 3 (Effect and Modification of the Terms)

These Terms take effect when the User agrees to them and uses the Service.

The Company may modify these Terms to the extent permitted by applicable laws. When the Company modifies these Terms, it will announce the modified content and the effective date through reasonable means such as in-service notices, email, or app push notifications, at least 7 days before the effective date.

If the User does not agree to the modified Terms, the User may stop using the Service and withdraw membership (terminate the contract). If the User continues to use the Service after the effective date, the User is deemed to have agreed to the modified Terms.

Article 4 (Provision and Modification of the Service)

The Company provides the Service 24 hours a day, year-round, in principle, but the Service may be temporarily suspended due to maintenance, faults, or circumstances of communication / cloud / payment providers.

The Company may modify the content of the Service (models, filters, UI, storage methods, etc.) to improve quality, strengthen safety, and enhance features. The Company may restrict or discontinue specific features when necessary for service operation or compliance with laws.

Article 5 (Accounts, Guardian-Based Use, and Responsibilities)

Only adults (guardians) may create accounts and purchase Paid Services.

The User is responsible for managing and supervising the Service use of End Users (including children) and, in particular, when a child End User is speaking with the plush toy, must comply with the following.

  • Guide the child so that they do not speak or enter sensitive or unnecessary personal information such as national ID numbers, addresses, phone numbers, or account passwords.
  • Guide the child that the Service is a tool for education and language learning, and not to use it in medical, legal, or emergency situations.
  • Securely manage account credentials, payment methods, and device access permissions.

The User must comply with the usage methods and precautions indicated on the Service screens.

Article 6 (No Audio Storage; Conversation Transcript Storage)

Audio (voice) data is not stored. The Company may temporarily process audio data to provide real-time conversation, but does not retain raw audio files on its servers / internal systems after the Service is provided.

The Company may store conversation text transcripts for service provision and quality improvement. The items stored, purposes, retention periods, deletion methods, processor entrustment / cross-border transfers, and other details are governed by the Company's Privacy Policy.

Users may use the conversation transcript viewing / deletion features (where provided) within the scope offered by the Service. Upon membership withdrawal, the Company processes Conversation Data in accordance with applicable laws and the Privacy Policy.

Article 7 (Child Safety and Prevention of Inappropriate Content)

Given the nature of conversational AI services, the Company implements reasonable safety measures, such as safety policies (system prompts / rules), filtering, block lists, and safety reviews, to prevent the provision of inappropriate information.

Nevertheless, due to the limitations of AI technology, inappropriate or inaccurate responses may occur in some situations. Users acknowledge this and should use the Service with particular care.

Users and End Users must not request or induce content involving sexual, violent, hateful, harassing, self-harm / suicide-related, unlawful, weapon / drug-related dangerous activities, or the collection of others' personal information.

In emergency situations (risk of self-harm, crimes, medical emergencies, etc.), do not use the Service and immediately contact relevant authorities such as 911 (USA) or 112 / 119 (Korea).

Article 8 (Prohibited Actions)

Users must not engage in any of the following.

  • Impersonating others' accounts or fraudulently using payment methods
  • Compromising the security of the Service / servers / networks, reverse engineering, generating abnormal traffic, or exploiting vulnerabilities
  • Distributing illegal or harmful information, or inducing conversations inappropriate for children
  • Infringing the intellectual property rights of the Company or third parties, defamation, or interference with business operations
  • Any act that violates laws or public order and morals

Article 9 (Use Restrictions and Termination)

Users may request to withdraw membership at any time, and the Company will process such requests in accordance with applicable laws and the Privacy Policy.

The Company may restrict Service use (including temporary suspension, feature limitations, or contract termination) when the User violates these Terms, when it is necessary for safety / security reasons, or when legally required.

Article 10 (Paid Services, Subscriptions, and Payments)

The types, prices, billing cycles, auto-renewal status, and scope of Paid Services are governed by what is displayed on the Service screens and payment screens (including store product descriptions).

Paid Service payments may be processed through Stores such as the Apple App Store or Google Play. In such cases, payment, billing, receipt issuance, subscription management, and refund processing are subject to the policies and procedures of the relevant Store.

Subscriptions are, in principle, automatically renewed, and users may cancel subscriptions through the method provided by the relevant Store.

Article 11 (Refunds and Cancellation)

Refund requests and processing for Store payments (including subscriptions) are subject to the refund policies and procedures of the relevant Store.

The Company cannot guarantee or arbitrarily approve refunds for transactions processed through a Store. Users who wish to request a refund must first follow the relevant Store's procedures.

However, in cases of defects in the Service, discrepancies with advertised content, or applicable mandatory statutory provisions, refunds may be processed in accordance with relevant laws and Store policies.

Article 12 (Intellectual Property and Use of Conversation Data)

Intellectual property rights to the Service and the software, UI, characters, trademarks, logos, and other elements provided by the Company belong to the Company or its legitimate rights holders.

The processing and use of Conversation Data such as conversation transcripts generated or entered by Users in the course of using the Service are subject to the Privacy Policy and applicable laws.

Users must not use results / information obtained through the Service in a manner that infringes third-party rights, or present them in a way that misleads others into treating them as definitive expert advice.

Article 13 (Limitations of AI Responses and Disclosures)

The Service's AI responses are generated probabilistically and may be inaccurate, out of date, or inappropriate in certain situations (including "hallucinations").

The Service does not replace professionals in areas requiring highly specialized judgment such as medical, legal, financial, or safety matters.

Article 14 (Damages and Limitation of Liability)

Except in cases where damages are caused to Users by the Company's willful misconduct or gross negligence, the Company limits its liability to the extent permitted by applicable laws.

The Company shall not be liable for indirect damages (loss of business, loss of expected profits, data loss, etc.) to the extent permitted by applicable laws.

Article 15 (Privacy Policy)

The Company complies with applicable privacy laws, and the collection, use, storage, deletion, processor entrustment / cross-border transfer of personal information and Conversation Data, as well as how Users exercise their rights, are governed by the Company's Privacy Policy.

Article 16 (Additional Policies and Priority)

The Company may establish individual policies (the "Policies") for service operation, such as the Privacy Policy, safety policies, and payment / subscription guidelines. If a Policy conflicts with these Terms, the Policy may take precedence solely with respect to its subject matter, and the Company will announce any changes in accordance with Article 3.

Article 17 (Governing Law and Jurisdiction)

These Terms shall be interpreted and applied to the extent they do not violate any mandatory provisions applicable to Users or any applicable rules of international private law.

Disputes between the Company and the User shall first be resolved through consultation. If consultation fails, the court having jurisdiction over the Company's location shall be the court of first instance. However, if mandatory consumer protection regulations apply to the User, they shall prevail.
